SECTION 1 — OVERVIEW

Trust AR LLC d/b/a Alt+Shift+X respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This policy describes how to report alleged copyright infringement on the Platform, how we respond to valid takedown notices, and how affected parties may submit counter-notifications.

Alt+Shift+X operates as an online service provider hosting content submitted by third-party Builders. We do not pre-screen all content submitted to the marketplace. If you believe content on the Platform infringes your copyright, please follow the procedure below.

SECTION 2 — DESIGNATED DMCA AGENT

To submit a DMCA takedown notice or counter-notification, contact our designated DMCA Agent:

DMCA Agent: Trust AR LLC d/b/a Alt+Shift+X — Legal Mailing Address: 1405 Earl L. Core Rd., Morgantown, WV 26501, United States Email: info@altshiftx.tech Subject line: "DMCA Takedown Notice" or "DMCA Counter-Notification"

We recommend email as the fastest method. We aim to acknowledge all DMCA notices within 2 business days.

Note: This agent is registered with the U.S. Copyright Office under Trust AR LLC per 17 U.S.C. § 512(c)(2).

SECTION 3 — SUBMITTING A TAKEDOWN NOTICE

If you believe content on the Platform infringes your copyright, you may submit a written takedown notice to our DMCA Agent. To be valid under 17 U.S.C. § 512(c)(3), your notice must include ALL of the following:

(a) Identification of the copyrighted work. A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.

(b) Identification of the infringing content. A description of the content you claim is infringing — specific enough for us to locate it on the Platform. Include the URL or URLs of the allegedly infringing content where possible.

(c) Your contact information. Your full name, mailing address, telephone number, and email address.

(d) Good faith statement. A statement that you have a good faith belief that the use of the copyrighted content in the manner complained of is not authorized by the copyright owner, its agent, or the law.

(e) Accuracy statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

(f) Signature. Your physical or electronic signature.

Incomplete notices will not be processed. Submitting a materially false takedown notice may expose you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

SECTION 4 — HOW WE RESPOND TO VALID NOTICES

Upon receipt of a complete, valid DMCA takedown notice, Alt+Shift+X will:

  1. Promptly remove or disable access to the allegedly infringing content;
  2. Notify the Builder (the party who submitted the content) that their content has been removed and provide them a copy of the notice;
  3. Inform the Builder of their right to submit a counter-notification under Section 5.

We reserve the right to terminate the accounts of repeat infringers in appropriate circumstances.

SECTION 5 — COUNTER-NOTIFICATION PROCEDURE

If you are a Builder whose content has been removed and you believe the removal was in error or the result of misidentification, you may submit a counter-notification to our DMCA Agent. Under 17 U.S.C. § 512(g)(3), your counter-notification must include ALL of the following:

(a) Identification of the removed content. A description of the content that was removed and its location on the Platform before removal.

(b) Statement under penalty of perjury. A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.

(c) Your contact information. Your full name, mailing address, telephone number, and email address.

(d) Consent to jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the U.S. District Court for the Northern District of West Virginia), and that you will accept service of process from the person who submitted the original takedown notice or their agent.

(e) Signature. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will:

  1. Forward the counter-notification to the original complainant;
  2. Inform the complainant that we will restore the removed content in 10–14 business days unless the complainant notifies us that they have filed a court action seeking an order restraining the allegedly infringing activity.

SECTION 6 — REPEAT INFRINGER POLICY

In accordance with 17 U.S.C. § 512(i), Alt+Shift+X maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. A "repeat infringer" is a Builder who has had content removed in response to two or more valid DMCA takedown notices within a 12-month period, or who has otherwise demonstrated a pattern of infringing behavior.

SECTION 7 — MISUSE OF THE DMCA PROCESS

Submitting a knowingly false or materially misleading takedown notice is a violation of 17 U.S.C. § 512(f) and may expose you to civil liability for damages including costs and attorneys' fees. Alt+Shift+X reserves the right to pursue remedies against parties who submit bad-faith notices.
